Mediation clause

The inclusion in the contract of a specific clause regarding the mediation of disputes that may arise in the contract implementation has become an aspect of fundamental importance.

Parties wishing to use proceedings under the ADR Center Romania Mediation Rules should consider choosing the mediation clause below.

However, before inserting any model clause or modifying an existing one, it is good practice to consult a lawyer.

“The parties agree that any dispute, controversy or request arising as a result or in relation to this contract (including any dispute regarding its conclusion, execution or termination), will be resolved through the mediation procedure by ADR Center Romania in compliance with the Rules of Mediation of ADR Center Romania. The state or arbitral courts are competent only after the failure of the mediation procedure performed in compliance with the Mediation Rules of the ADR Center Romania.”
